TERMS & CONDITIONS

At checkout you will be asked to agree to the terms and conditions, approval of the terms and conditions is required to proceed with the purchase.

Below you will find more information about returns and refunds.

Article 1: General provisions
 

The webshop of Hair by V, with registered office at Nieuwe Kuilenweg 15/11, 3600 Genk, BTW BE 1004005230, (hereinafter referred to as 'Hair by V') offers its customers the opportunity to purchase the products from its webshop online.

Our terms and conditions apply to every Hair by V product and are in force between Hair by V and each individual user of the website who places an order via the webshop (hereinafter: "Customer").

When placing an order through the Hair by V webshop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Client are excluded, unless they have been expressly accepted in advance in writing by Hair by V. We reserve the right to change our terms and conditions at any time.

 

Article 2: Price
 

All prices are indicated in euros and include VAT and exclude any packaging and/or shipping costs (shipping within Belgium is free of charge).

Transport or shipping costs for orders and delivery outside Belgium are charged separately and are always at the expense of the customer, unless otherwise stated. You can consult these prices under 'Shipping and Returns'.

Orders outside of Europe may be subject to additional taxes and customs duties imposed by the destination country. Recipients are liable for the taxes, duties, and customs fees associated with the nominated country of delivery. These taxes are non-refundable in case of returns/exchanges.

The price applicable to the contract of sale is the price in force at the time of the registered order and as indicated on the website at that time. The price refers exclusively to the item as described verbatim. The accompanying photos are decorative and may contain elements that are not part of the items and are not included in the price. If, due to an error or mistake, there is an incorrect price on an item in our webshop, we always have the right to change this price. You will then have the right to cancel the order and the full amount will be refunded to your account.

 

Article 3: Offer
 

Hairpieces, toppers and wigs made of real human hair. The products offered on the Hair by V webshop are presented on the website in the form of a description with the most important characteristics (size, length, color, hair type). The photos are as true to nature as possible, but do not bind Hair by V in any way.

Hair by V reserves the right to change the product range at any time.

Despite the fact that the webshop is compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Hair by V. As far as the accuracy and completeness of the information provided, Hair by V is only bound by an obligation of means. Hair by V is in no way liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we ask the Customer to contact us in advance via info@hairbyv.shop.

The offer is always valid while stocks last and can be adjusted or withdrawn at any time by Hair by V. Hair by V cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

The customer can choose between a hairpiece in stock and a custom-made one.

The store items are used to showcase the products and provide a detailed product description.

 

Custom order / pre-order
 

Depending on the selection, custom orders can take at least 4-16 weeks or 16-20 weeks . In some cases, depending on availability, an order can be in production for significantly longer. A tailor-made order is accompanied by a prior consultation with the seller.

A customer should read the product information carefully. Your choice and confirmation of an order placed means that you agree to the Terms and Conditions.

Payment to Hair by V must  be made in full before the order is put into production. Once the order has been placed, no changes can be made. You will receive a confirmation of your order from us.

An order will only be shipped after full payment has been received.

 

Return Policy
 

No refunds will be accepted for custom orders.

If you have indicated or requested to cut the lace of a wig, this is also considered a custom order, as well as a custom cut and color.

Returns that are worn, soiled or damaged will not be accepted and may be returned to you.

Sale items cannot be exchanged or refunded.

Your choice and confirmation of an order placed means that you agree to the Terms and Conditions.

 

Article 4: Online purchases
 

Payment is made electronically and in EURO. You can pay with Bancontact, Maestro, PayPal, Visa, among others. The purchase will be made when we have received a confirmation of your payment, until then the ordered items are the property of Hair by V.

Hair by V is entitled to refuse an order due to a serious shortcoming on the part of the Client with regard to orders in which the Client is involved.

Article 5: Delivery and execution of the agreement
 

Free national shipping in Belgium. Hair by V does not charge for deliveries in Belgium.

International Shipping -> DHL Express Worldwide Shipping

In most cases, delivery arrives between 1-3 days. Please allow approx. 5 working days for delivery to all destinations. DHL tracking information will be provided after your order has been shipped.

Orders for stock items will be shipped the next business day after receipt of payment. If you have asked for additional cuts or colors to be added to your piece, please note that Hair by V takes about 1-3 weeks to complete the order.

 

Payment is made electronically and in EURO. You can pay with Bancontact, Maestro, PayPal, Visa, Klarna. The purchase is made when we have received a confirmation of your payment, until that moment the ordered items are the property of Hair by V.

Hair by V is entitled to refuse an order due to a serious shortcoming on the part of the Client with regard to orders in which the Client is involved.

Unless otherwise agreed or expressly stipulated otherwise, the goods will be delivered to the customer's place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to Hair by V.

The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk is already transferred to the Client upon delivery to the carrier, if the carrier has been instructed by the Client to transport the goods and this choice was not offered by Hair by V.

 

Shipping with insurance
 

Customers have the option to select shipping insurance at checkout. If no shipping insurance is selected, Hair by V or the Shipping Company will not be liable for lost, stolen, or damaged packages.

 

Signature required for receipt
 

When shipping or ordering high-value items, it is best to ask for a signature to release your package. This will prevent it from falling into the wrong hands.

 

Wrong address disclaimer
 

We want to make sure you receive your new hair, so make sure you enter the correct shipping address and contact name of the person who can receive it. This is your responsibility. Please check it. If you make a mistake or things change, please write to us immediately info@hairbyv.shop  and maybe we can adjust your order. We can't promise anything as we process and ship our orders as soon as possible, but we will do our best.

 

Delivered but not received
 

I try to ensure successful deliveries by providing you with tracking. If your item is marked as delivered to the address but you have not received it, please contact the couriers. You should also check that the address you provided to us was correct.

We cannot be held responsible when packages marked as delivered to a particular address have not been received.

The sale of our products is intended for all buyers residing in countries that fully allow the import of human hair products into their territory.

International shipments may be subject to duties, taxes, and other charges that are not included in the total price. The delivery time depends on the processing time of the relevant customs.

If the customer chooses to pick up the goods, he must arrange for full payment on the spot (cash or online payment).

 

Article 6: Retention of title
 

The goods must be paid for, in cash and without discount, before Hair by V proceeds with the shipment of the goods. In the event of non-payment, incomplete or late payment, Hair by V reserves the right not to ship the ordered goods pending full settlement of the outstanding balance.

The goods remain the property of Hair by V until full payment of their price.

If necessary, the Client undertakes to draw the attention of third parties to Hair by V's retention of title, e.g. to anyone who comes to seize the items that have not yet been paid for in full.

 

Article 7: Right of withdrawal
 

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase items online from Hair by V.

The customer has a period of 14 days to withdraw from the distance contract without giving reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the goods. The customer can only exercise this right insofar as he revokes the entire order.

This means that the buyer must return the product to the post office within those 14 days and come back to us with the tracking information (track and trace).

The shipping costs of the return shipment are the responsibility of the buyer. If the customer has paid an amount, Hair by V will refund this amount as soon as possible, but no later than 14 days after withdrawal. However, this is subject to the condition that the product has already been received back by Hair by V or conclusive proof of complete return can be submitted.

The products must be returned in the original packaging and in new condition.

All items must be returned in their original condition and must not be altered in any way (meaning no dyeing, silk and lace intact/uncut heat styling, washing, cutting, removing clips or combs etc.)

If the piece has been altered in a way that we cannot refund, the piece will be returned to the buyer at our own expense. All taxes are also the responsibility of the buyer.

If the returned product is depreciated in any way, Hair by V reserves the right to hold the Customer liable and claim compensation for any decrease in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to change the nature,  determine the characteristics and functioning of the goods.

All returned items will be carefully examined. The basic principle here is that the consumer may only inspect the item as he would be allowed to do in a shop. Returned items may be tried on, but may not have been used. If an item has been depreciated by the use of the Customer, this will be charged to the Customer.

In accordance with the relevant provisions of the Code of Economic Law, the customer cannot exercise the right of withdrawal for the delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery.
 

No returns/refunds are possible for:

  • Items on sale.

  • Wigs where the lace/lace is cut in front

  • Personalized/customized/custom orders/cut pieces, custom orders are also non-refundable, as these pieces are specially made to the buyer's liking.
     

Unlike the pieces that are available in stock, we cannot accept returns or exchanges for custom orders. A custom-made piece will be designed for you. It is more difficult to resell a piece that has been made for you because it has been specially manufactured according to your own criteria and specifications.

Should the package get lost on the way back to us, it is up to the buyer to contact the courier service to arrange compensation. Hair by V is not responsible for packages that are lost during return.

 

Hair by V asks for a 10% restock fee which will be deducted from the buyers' refund to cover the credit card transaction fee (these fees are non-refundable when processing a return to the customer) washing, restyling and relisting the piece for sale on the website.

In order to exercise the right of withdrawal, the Client, Hair by V, Nieuwe Kuilenweg 15/11, 3600 Genk (Belgium), must  inform info@hairbyv.shop  of its decision to withdraw from the contract by means of an unambiguous statement (e.g. in writing by post or e-mail).

The Customer may use the model withdrawal form for this purpose, but is not obliged to do so.

The Client may also complete the model withdrawal form or other clearly worded declaration electronically and send it via the website https://economie.fgov.be/nl/themas/consumentenbescherming/opkomen-voor-uw-rechten/uw-aankopen/een-aankoop-annuleren/wanneer-hebt-u-een-wettelijk/uw-herroepingsrecht-uitoefenen

If the Customer makes use of this option, we will immediately send the Customer an acknowledgement of receipt of his revocation on a durable medium (e.g. by e-mail).

Any additional costs resulting from the Client's choice of a method of delivery other than the cheapest standard delivery offered by Hair by V will not be refunded.

Hair by V will reimburse the Client using the same means of payment as the Client used to carry out the original transaction, unless the Client has expressly agreed otherwise; in any case, the Client will not be charged any costs for such reimbursement.

The Client may not exercise the right of withdrawal for:

  • the delivery of goods manufactured to the Customer's specifications, or clearly intended for a specific person: custom orders/custom goods

  • the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;

  • the delivery of goods which, by their nature, are irrevocably mixed with other products after delivery.

 

Article 8: Warranty
 

In accordance with the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. Each item is subject to the legal warranty from the date of purchase by (if applicable, delivery to) the first owner. Any commercial guarantee does not affect these rights.

 

In order to invoke the warranty, the buyer must be able to provide proof of purchase and contact Hair by V in advance, after which the customer must return the item to Hair by V at his/her expense. Any defect must be reported within 10 days of its discovery. After that, any right to repair or replacement will lapse.

The warranty (commercial and/or legal) never applies to defects that arise as a result of accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or modifications to the item, rough use, poor maintenance,  abnormal or improper use. It also does not apply to items with a shorter lifespan, or wear and tear items. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless the Customer proves otherwise.

The warranty is non-transferable.

Article 10: Penalties for non-payment
 

Without prejudice to the exercise of other rights available to Hair by V, in the event of non-payment or late payment from the date of the default, the Client will owe interest at the rate of 10% per annum on the unpaid amount by operation of law and without notice. In addition, the Client is required by operation of law and without notice to pay a lump sum compensation of 10% of the amount in question, with a minimum of 25 euros per invoice.

For the purpose of calculating these periods, each month started is considered to be a full month.  In the absence of payment on the due date, all sums due shall become immediately due and payable, whatever the payment facilities previously granted.  Furthermore, Hair by V reserves the right to no longer supply goods and services until all payments have been processed.

As soon as the customer fails to comply with his contractual obligations, Hair by V can either suspend his obligations or dissolve the agreement by operation of law and without prior notice of default.  Of course, this also applies to the customer if Hair by V does not comply with its contractual obligations.

Without prejudice to the foregoing, Hair by V reserves the right to take back the items that have not been (fully) paid for.

 

Article 11: Privacy
 

Hair by V respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.

We treat your data as confidential information and will never pass it on, rent or sell it to third parties. However, we do pass on your details (e.g. e-mail address and telephone number) to the courier service so that they can send you a confirmation e-mail and/or SMS with a track and trace number. If you do not want this, please mention this in the ordering process. The customer is responsible for keeping his/her login details confidential and for the use of his/her password. Your password is stored encrypted, so Hair by V does not have access to your password.

You have a legal right to inspect and possibly correct, supplement or delete your personal data. In a number of cases listed in the GDPR, you may also request that the processing of your personal data be restricted. You can also object to the processing of your personal data if you have serious and legitimate reasons for doing so that go beyond our need to process your data. By sending a written, dated and signed request to Hair by V, Nieuwe Kuilenweg 15/11, 3600 Genk (Belgium) info@hairbyv.shop , you can request your personal data in digital and readable form free of charge and/or have them transferred to other controllers. To the extent that our processing is based on your prior consent, you have the right to withdraw that consent.

In case of use of data for direct marketing: You can object to the use of your data for direct marketing free of charge and do not have to give a reason for this.

Article 12: Use of cookies
 

Our webshop uses cookies and similar technologies. This helps us to provide you with a better user experience when you visit our Website and also allows us to optimise our Website. Without your prior consent, we only place the purely functional cookies that are necessary for our website to work correctly. For all other cookies, we first ask for your permission.

When you visit our website for the first time, you will be asked to accept our cookies. You can then manage your choices yourself at any time.

You can set your internet browser in such a way that cookies are not accepted, that you receive a warning when a cookie is installed or that the cookies are subsequently deleted from your hard drive. You can do this via the settings of your browser (via the help function). Keep in mind that certain graphic elements may not appear correctly, or that you will not be able to use certain applications.

 

Article 13: Impairment of validity - non-renunciation


If any provision of these Terms and Conditions is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.

The failure of Hair by V at any time to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right thereof, shall never be deemed to be a waiver of such provision and shall never affect the validity of such rights.

Article 14: Modification of terms and conditions


These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to, and the general terms and conditions of sale of Hair by V.  In the event of a conflict, these Terms and Conditions shall prevail.

 

Article 15: Evidence


The Client accepts that electronic communications and back-ups may serve as evidence.

 

Article 16: Applicable law – Disputes


Belgian law is applicable, with the exception of the provisions of private international law on applicable law.

The courts of the Consumer's domicile have jurisdiction in judicial disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
