TERMS & CONDITIONS

 

At checkout you will be asked to agree to the terms and conditions, approval of the terms and conditions is required to proceed with the purchase.

Below you will find more information about returns and refunds.

ARTICLE 1: GENERAL PROVISIONS
 

The webshop of Hair by V, registered at Nieuwe Kuilenweg 15/11, 3600 Genk, VAT BE 1004005230, (hereinafter referred to as "Hair by V") offers customers the opportunity to purchase products from its webshop online. These terms and conditions apply to all products offered by Hair by V and govern the contractual relationship between Hair by V and its customers.

 

By placing an order, the Customer accepts these terms and conditions, excluding all other conditions unless explicitly agreed upon in writing. Hair by V reserves the right to modify these terms at any time, and any changes will be communicated clearly to the Customer.

 

ARTICLE 2: PRICE
 

All prices are listed in EURO and include VAT. For deliveries within Belgium, no shipping costs apply. For deliveries outside Belgium, shipping costs, taxes, and/or customs fees may apply, and these will be charged to the Customer unless stated otherwise. You can consult these prices under 'Shipping and Returns'.

 

Orders placed from outside Europe may be subject to additional customs duties, taxes, and fees. These are the responsibility of the recipient and are non-refundable in the case of returns or exchanges.

 

Prices shown on the website at the time of order placement are final and apply to the specific product only. If an incorrect price is displayed due to a mistake, Hair by V reserves the right to correct the price. The Customer may cancel the order if the price change is not acceptable.

 

ARTICLE 3: OFFER
 

Our products include hairpieces, toppers, and wigs made of real human hair. Each product is presented with an accurate description of its key features (size, length, color, hair type). While we make every effort to ensure product photos are accurate, they are for illustrative purposes only and may not perfectly match the final product.

 

In case of incomplete or outdated information, Hair by V will not be held liable for obvious errors. Customers with specific inquiries about size, color, availability, or other product details are encouraged to contact us before placing an order at info@hairbyv.shop.

 

The offer is always valid while stocks last and can be adjusted or withdrawn at any time by Hair by V.

Hair by V cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

The Customer can choose between a hairpiece in stock and a custom-made one.

The store items are used to showcase the products and provide a detailed product description.

 

ARTICLE 4: PAYMENTS
 

Payments are processed electronically in EURO via Visa / Mastercard / American Express / Union Pay / Jcb / Diners Club /  Discover / Electron / Maestro / Apple Pay / PayPal / Bancontact / iDeal & Klarna, among others. All transactions are secured through encryption technologies to protect your payment information.

The sale is complete once Hair by V receives payment confirmation. Ownership of the products passes to the Customer upon successful receipt of full payment.

 

​ARTICLE 5: SHIPPING/DELIVERY

 

Free shipping within Belgium. In case of a return/refund, the shipping cost will not be refunded.

For international orders, shipping fees are calculated at checkout and provided by DHL Express. Orders for in-stock items are dispatched within 1-3 business days after payment confirmation. For items requiring additional cuts or color customization, please allow 1-3 weeks for fulfillment.

 

For international orders, delivery is typically within 1-5 business days. Tracking information will be provided. Hair by V is not responsible for delays due to customs or courier issues.

 

Important: If the Customer selects the shipping option without insurance, Hair by V is not liable for lost or damaged items in transit. Customers can opt for insured shipping at checkout.

 

Hair by V is entitled to refuse an order due to a serious shortcoming on the part of the Client with regard to orders in which the Client is involved.

Unless otherwise agreed or expressly stipulated otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to Hair by V.

 

Shipping with insurance

Customers have the option to select shipping insurance at checkout. If no shipping insurance is selected, Hair by V or the Shipping Company will not be liable for lost, stolen, or damaged packages.

 

Signature required for receipt

When shipping or ordering high-value items, it is best to ask for a signature to release your package.

This will prevent it from falling into the wrong hands.

 

Wrong address disclaimer

Hair by V wants to make sure you receive your new hair, so make sure you enter the correct shipping address and contact name of the person who can receive it. This is your responsibility. Please check it.

If you make a mistake or things change, please write to us immediately info@hairbyv.shop  and maybe we can adjust your order. We can't promise anything as we process and ship our orders as soon as possible, but we will do our best.

 

Delivered but not received

Hair by V tries to ensure successful deliveries by providing you with tracking. If your item is marked as delivered to the address but you have not received it, please contact the couriers. You should also check that the address you provided to us was correct.

We cannot be held responsible when packages marked as delivered to a particular address have not been received.

The sale of our products is intended for all buyers residing in countries that fully allow the import of human hair products into their territory.

International shipments may be subject to duties, taxes, and other charges that are not included in the total price. The delivery time depends on the processing time of the relevant customs.

If the Customer chooses to pick up the goods, he must arrange for full payment on the spot (cash or online payment).

 

ARTICLE 6: RETENTION OF TITLE
 

The goods must be paid for, in cash and without discount, before Hair by V proceeds with the shipment of the goods. In the event of non-payment, incomplete or late payment, Hair by V reserves the right not to ship the ordered goods pending full settlement of the outstanding balance.

The goods remain the property of Hair by V until full payment of their price.

If necessary, the Client undertakes to draw the attention of third parties to Hair by V's retention of title, e.g. to anyone who comes to seize the items that have not yet been paid for in full.

 

ARTICLE 7: CUSTOM ORDER / PRE-ORDER
 

Depending on the selection, custom orders can take at least 4-16 weeks or 16-20 weeks. In some cases, depending on availability, an order can be in production for significantly longer. A tailor-made order is accompanied by a prior consultation/communication with Hair by V.
 

Payment for custom orders must be made in full before production begins. Once the order is confirmed, no changes can be made, and the order becomes non-refundable.

Hair by V encourages customers to carefully review product information prior to making a purchase. Once an order is placed, the Customer acknowledges and agrees to these terms and conditions.

 

ARTICLE 8: RETURNS, REFUNDS & EXCHANGES -

RIGHT OF WITHDRAWAL (THIS APPLIES TO STOCK/READY TO SHIP PIECES)

 

Return Policy
 

Custom orders, pre-orders & sale items, including wigs and toppers that have been cut or colored, are non-refundable and non-exchangeable.

If you have requested to cut the lace of a wig, this is also considered a custom order, as well as a custom cut and color. Shipping costs, credit card charges, potential import duties and any other fees are non-refundable.

 

A Customer is liable to carefully read the product information and mandatory declare they have read these Terms and Conditions prior to making an order. Your selection and confirmation of any order placed indicates your acceptance of our Terms and Conditions.

 

Stock / ready to ship pieces

 

Customers have the right to withdraw from a stock order within 14 calendar days after receiving the item.

The return shipping costs are the responsibility of the Customer.

Refunds are processed within 10 working days after Hair by V receives and inspects the item. In cases where the product is found to be depreciated due to the Customer’s handling, Hair by V reserves the right to issue only a partial refund.

 

Return Procedure

 

To return an item, the Customer must contact us at info@hairbyv.shop within 7 working days of receiving the item. Once approved, the return must be completed within 14 days, including providing tracking information to Hair by V. It is your responsibility to ensure the safe delivery of the item and ensure the item is returned in its original condition and has not been altered.

Hair by V will provide you with a return shipping label to attach to your package for shipping with DHL Express and will deduct the cost of shipping from your refund amount. For returns within Belgium, the Client is responsible for the return.

 

Hair by V only accepts your return/exchange/store credit if:

 

  • It is in new condition, has all original tags, not been worn, used or damaged. You must ensure the item has not been altered in any way i.e. lace cutting.

 

  • Is not soiled by fake tan, makeup or hair products. This means no washing, no dyeing, using heat tools, removing the clips or wear.  When trying on the piece, please ensure your own hair/head is clean and does not contain any product or hair fibers, sprays, powders or similar. Please brush the topper or wig and ensure all the combs & clips are closed before shipping the product back. The product should be free of any odors (smoke, pets, perfumes, etc).

 

  • Is posted back within 14 days of receipt.

 

If you fail to comply with these terms and conditions, you will not be entitled to a refund/exchange/store credit. Any returns that are worn, soiled or damaged will not be accepted and may be returned to you.

 

  • Once we have received your return, you will receive an email notification.

 

  • Processing of the return usually takes 10-14 working days.

 

  • Refunds will be made immediately after processing and should show in your account within 10 days, depending on your bank’s timescales.

 

All returned items will be carefully examined. The basic principle here is that the consumer may only inspect the item as he would be allowed to do in a shop. Returned items may be tried on, but may not have been used. If an item has been depreciated by the use of the Customer, this will be charged to the Customer.

 

In accordance with the relevant provisions of the Code of Economic Law, the Customer cannot exercise the right of withdrawal for the delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery.

 

No returns/refunds are possible for:

  • Items on sale.

  • Wigs/toppers where the lace/lace is cut.

  • Personalized/customized/custom orders/pre-orders/cut pieces, as these pieces are specially made to the buyer's liking.

 

Should the package get lost on the way back to us, it is up to the buyer to contact the courier service to arrange compensation. Hair by V is not responsible for packages that are lost during return.

 

Hair by V can ask for a 10% restock fee which will be deducted from the buyers' refund to cover the credit card transaction fee (these fees are non-refundable when processing a return to the Customer) washing, restyling and relisting the piece for sale on the website.

 

In order to exercise the right of withdrawal, the Client, Hair by V, Nieuwe Kuilenweg 15/11, 3600 Genk (Belgium), must inform info@hairbyv.shop of its decision to withdraw from the contract by means of an unambiguous statement (e.g. in writing by post or e-mail).

 

The Customer may use the model withdrawal form for this purpose, but is not obliged to do so.

The Client may also complete the model withdrawal form or other clearly worded declaration electronically and send it via the website https://economie.fgov.be/nl/themas/consumentenbescherming/opkomen-voor-uw-rechten/uw-aankopen/een-aankoop-annuleren/wanneer-hebt-u-een-wettelijk/uw-herroepingsrecht-uitoefenen

 

If the Customer makes use of this option, we will immediately send the Customer an acknowledgement of receipt of his revocation on a durable medium (e.g. by e-mail).

 

Hair by V will reimburse the Client using the same means of payment as the Client used to carry out the original transaction, unless the Client has expressly agreed otherwise; in any case, the Client will not be charged any costs for such reimbursement.

 

The Client may not exercise the right of withdrawal for:

  • the delivery of goods manufactured to the Customer's specifications, or clearly intended for a specific person: custom orders/pre-orders/custom goods

  • the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;

  • the delivery of goods which, by their nature, are irrevocably mixed with other products after delivery.

ARTICLE 9: WARRANTY
 

Hair by V offers a 6-month limited warranty for all products from the date of delivery. The warranty covers material and workmanship defects. It does not cover damage caused by accidents, misuse, or failure to follow care instructions.

 

To make a warranty claim, the Customer must notify Hair by V within 10 days of discovering the defect. Hair by V will inspect the item and determine if the defect is covered under warranty.

 

ARTICLE 10: CUSTOMER SERVICE

For inquiries regarding your order, product details, or any other questions, you can contact us at info@hairbyv.shop. Hair by V aims to respond to all customer inquiries within 24 hours.

 

 

ARTICLE 11: PENALTIES FOR NON-PAYMENT
 

If the Customer fails to pay on time, interest of 10% per annum will be applied. Additionally, a flat-rate compensation of 10% of the unpaid amount (with a minimum of €25) may be applied to cover collection costs.

 

Hair by V may suspend or cancel orders if payments are not received in full.

 

ARTICLE 12: PRIVACY
 

Hair by V respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.

We treat your data as confidential information and will never pass it on, rent or sell it to third parties. However, we do pass on your details (e.g. e-mail address and telephone number) to the courier service so that they can send you a confirmation e-mail and/or SMS with a track and trace number. If you do not want this, please mention this in the ordering process. The Customer is responsible for keeping his/her login details confidential and for the use of his/her password. Your password is stored encrypted, so Hair by V does not have access to your password.

 

You have a legal right to inspect and possibly correct, supplement or delete your personal data. In a number of cases listed in the GDPR, you may also request that the processing of your personal data be restricted. You can also object to the processing of your personal data if you have serious and legitimate reasons for doing so that go beyond our need to process your data. By sending a written, dated and signed request to Hair by V, Nieuwe Kuilenweg 15/11, 3600 Genk (Belgium) info@hairbyv.shop , you can request your personal data in digital and readable form free of charge and/or have them transferred to other controllers. To the extent that our processing is based on your prior consent, you have the right to withdraw that consent.

In case of use of data for direct marketing: You can object to the use of your data for direct marketing free of charge and do not have to give a reason for this.

ARTICLE 13: USE OF COOKIES
 

Our webshop uses cookies and similar technologies. This helps us to provide you with a better user experience when you visit our Website and also allows us to optimize our Website. Without your prior consent, we only place the purely functional cookies that are necessary for our website to work correctly. For all other cookies, we first ask for your permission.

When you visit our website for the first time, you will be asked to accept our cookies. You can then manage your choices yourself at any time.

 

You can set your internet browser in such a way that cookies are not accepted, that you receive a warning when a cookie is installed or that the cookies are subsequently deleted from your hard drive. Keep in mind that certain graphic elements may not appear correctly, or that you will not be able to use certain applications.

 

ARTICLE 14: IMPAIRMENT OF VALIDITY - NON-RENUNCIATION


If any provision of these Terms and Conditions is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.

The failure of Hair by V at any time to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right thereof, shall never be deemed to be a waiver of such provision and shall never affect the validity of such rights.

ARTICLE 15: MODIFICATION OF TERMS AND CONDITIONS


These terms and conditions may be updated periodically. Changes will not affect orders that have already been placed.

 

ARTICLE 16: EVIDENCE


The Client accepts that electronic communications and back-ups may serve as evidence.

 

ARTICLE 17: APPLICABLE LAW – DISPUTES


Belgian law applies to these terms and conditions. In the event of a dispute, the courts of the Customer’s domicile will have jurisdiction, unless otherwise agreed by both parties. The Consumer may also turn to the ODR platform:  (http://ec.europa.eu/consumers/odr/).
